PROCEEDINGS

THE WTTNESS: All right. I want to make an objection that the court reporter has so noted that she does not know her oath of office, and thereby, anything that goes on here may or may not be true or factual, and there's no way of guaranteeing this.
MR. HALCOMB: Fine. Let's get started on the deposition. Swear the witness.
COURT REPORTER: Would you please raise your right hand to be sworn?
THE WITNESS: Do you have the authority to swear --
COURT REPORTER: Yes, I do have the authority.
(Discussion off record.)
MR. HALCOMB: Mr. Martin, you've been ordered by the Court to have your deposition taken. You filed your motion to quash. It was denied. We have a court reporter here. You have been abusive to her. You have questioned her. You have --
THE WITNESS: I object to that. believe I don't believe I was abusive to anybody.
MR. HALCOMB: You are challenging her

ethics. You're challenging her oath. You're challenging her ability to do her job.
THE WTTNESS: She does not know her oath.
MR. HALCOMB: The court reporter is in tears now. I want this on the record. Mr. Martin has so upset her, she cannot further go on. I want this noted on the record. We will make our motion for sanctions. Unless you agree to cooperate now, I am going to end this deposition. I'm going to go to the judge, and I'm going to get sanctions against you, so it's your choice on how you want to operate.
THE WITNESS: I object to that statement. My statement on the record is that I've been polite. I've been cordial. I've asked only for information that may tend to lead to a conflict of interest.
NR. HALCONB: All right. We're going off the record.
(The proceedings concluded at 10:20 a.m. on May 21, 2002.)
